The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. The attorney advises the Industrial Commission in performing its functions pursuant to G.S. 97-94 and represents the Commission in all litigation in State courts and administrative offices in which the Commission is a party. In performing its statutory functions, the Commission is charged with investigating suspected fraud and violations related to workers’ compensation claims, by or against insurers or self funded employers. The Commission will refer criminal violations to the appropriate district attorney. This attorney will prepare the cases for the district attorneys to prosecute. This attorney will litigate civil actions for fraud of collection of penalties in the General Courts of Justice, or in some instances, the Office of Administrative Hearings. This attorney may represent the Industrial Commission in any litigation involving personnel matters or matters relating to employee grievances and employment related litigation.
This attorney will provide a full range of legal support for the Industrial Commission and its investigators.
This attorney handles criminal briefs on appeal by the defendant to the North Carolina Court of Appeals and the Supreme Court. The attorney reviews the trial transcript, researches applicable law and files the brief in accordance with the Rules of Appellate Procedure. If decisions made by the Court of Appeals are appealed, the attorney follows the matter through to final disposition by the Supreme Court. If a case is selected for oral argument by the Court of Appeals or the Supreme Court, the attorney represents the State at the oral argument.

Knowledge Skills and Abilities/Management Preferences

1. Litigation experience, including motions practice, discovery (including written discovery and depositions), working with expert witnesses, and trials.

2. Well-versed legal research and writing, oral advocacy, and overall litigation strategies.

3. Knowledge of the N.C. Rules of Civil Procedure, the N.C. Rules of Evidence, the Tort Claims Act, the N.C. Rules of Appellate Procedure, and any other related statute, regulation or code.

Minimum Education and Experience

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience.
