As Privacy Counsel - Healthcare, you will be a member of Nuance's Legal team, reporting to and working closely with the Chief Privacy Officer, as well as with members of the privacy and commercial legal teams, IT Security, Sales, Product development, and other operational teams across the company. In addition to your primary focus on customer-facing work, you will support roll-outs of policies, procedures, guidelines, and trainings relating to data privacy.The primary work location will be based out of our Burlington, MA HQ facility once we return to working from our the office late this year or early next.We are able to consider candidates that could also be based out of our other hub locations in Mahwah, NJ, Melbourne, FL or Agoura Hills, CA.
Responsibilities:

  • Lead customer and vendor calls with respect to the review of data protection provisions in customer and vendor contracts, including the negotiation of BAAs and security agreements.
  • Assist and work closely with Legal and deal desk team members in the review of contract language impacting privacy and security provisions.
  • Perform legal analysis Privacy Impact Assessments ensuring appropriate contract language and transfer requirements are in place (as applicable).
  • Serve as the Data Privacy Subject Matter Expert
  • Maintain/implement privacy language as needed in playbooks, templates, and other standard documentation.
  • Draft, develop, and implement data subject information notice and consent documents.
  • Assist/work with Chief Privacy Officer, Data Protection Officer, and Chief Information Security Officer on data incident response, including assisting with preparation of required notifications pursuant to breach notification laws
  • Assist with the drafting of privacy and information security policies, procedures, training materials.
  • Coordinate with outside counsel to advise clients on privacy and security matters.
  • Provide guidance to legal and product management teams on issues pertaining to new and existing products/features throughout the entire development lifecycle.


Qualifications:

  • Admission to the American Bar Association is required.
  • 3+ years of privacy experience
  • 5+ years of relevant work experience in technology transactions or healthcare industry transactions
  • Strong knowledge of HIPAA and other healthcare privacy laws and regulations
  • Solid working knowledge of global data protection laws, liability issues, contract preparation and negotiation


Skills:

  • Excellent negotiation skills, with the ability and confidence to represent Nuance in the area of data privacy and security.
  • A proven record of success in-house and/or at a reputable law firm
  • Knowledge of data classification, data mapping and data management methodologies desired.
  • Certifications such as CIPP-US or CIPP-E are a plus.
  • Strong written and verbal communications skills, including the ability to communicate concisely to customers.
  • Ability to manage multiple tasks simultaneously and to flourish in a fast-paced environment.
  • Excellent organization, project management, and prioritization skills.
  • High level attention to detail, professionalism, integrity, and ability to maintain confidences while working with sensitive, confidential information.
